RWAG response to offer of talks with Ray Morgan and Cllr. John Kingsbury (6th April 2011)

 

Dear Cllr Kingsbury,
 
As set out in our previous correspondence we have submitted an application to register a portion of land in the ownership of Thamesway Developments Limited as a Village Green. We are confident of the legal strength of that case.
 
Further, we have drawn to your attention the significant liability you risk by commencing development on land not subject to the village green application. This is because should the land at section 4 be registered, the development carried out on other sections will become unlawful without a further planning application. We have sought legal advice on this point, and had the matter confirmed by the Borough Planning Officer, Mr Bishop. We are deeply concerned at the continued risk that the current actions by the developers could ultimately place the Council in.
 
The AGM of RWAG was held last week, and it will come as no surprise that the meeting hall was packed, and residents were standing in the aisles. The residents clearly articulated their anger at the manner in which the "Rydens Way Saga" continue to be mis-handled. Indeed when the offer of meeting with you and Mr Morgan was put forwards for discussion the decision was unequivocal - residents did not want to attend a meeting such as you propose  and be put into a position where a mere "tinkering" of designs was the outcome.
 
In the absence of a clear agenda we are not of the opinion a meeting at this stage would be productive.
